probate and fiduciary

A fiduciary is a person in a position of great trust, such as the executor of a will or the trustee of a trust. The beneficiary of a will or trust may have claims against a fiduciary who abuses or neglects his or her responsibilities by misusing estate or trust assets or otherwise failing to act in the beneficiary’s best interest. Similar claims may arise when a friend or caregiver takes advantage of a person who is elderly, ill, or unsophisticated. Of course, not all such claims are valid, and we have had success both in asserting valid claims against persons who sought to take wrongful advantage of others, and in defending fiduciaries and others who have been unfairly accused of wrongdoing.
